.5 Acre Mowing Service

 This service includes mowing grass accessible to us on up to .5 acres weekly. No other services of any kind are included. Mow-NoMore staff will not remove debris of any kind from the lawn including but not limited to outdoor furniture, toys, leaves, sticks, animal refuse, etc. Mow-NoMore is not responsible for damage done to items left on the lawn during mowing. All debris and refuse should be removed from the lawn prior to your weekly appointment. Debris and/or refuse will be mowed around if seen and that spot on the lawn will remain uncut until the item is removed by the customer and the spot can be cut again. If the debris and/or refuse is too abundant in our opinion, then your service may be cancelled for the week (you will not be charged for that week) and service will resume the following week provided the debris and/or refuse has been removed. If incidents like this are chronic in our opinion, your service may be cancelled permanently. If debris is not seen by our staff until it has been mowed over and has damaged our equipment, the customer will be automatically charged for the repairs in full. If animal refuse is not seen by our staff until it has been mowed over and has soiled our equipment, then the customer will be automatically charged a $20.00 Cleaning Fee. If the customer refuses to pay the fees (by charge-back, dispute, or other means) and/or the incidents are chronic in our opinion, your service may be cancelled permanently. Any unpaid balances will be submitted to collections and all collection costs will be included in the balance plus 1.5% interest compounded monthly.  We require access to all areas to be mowed, all gates must be unlocked, unobstructed, and easy to open (we will not climb, disassemble things or the like) or the inaccessible area will remain un-mowed. No discount will be provided for this. The service charge is for mowing what we can access up to .5 acres. Keep all access free and clear to maintain the maximum value of the service. Any and all animals must be secured and have absolutely no means of access to our staff. If unsecured animals are observed service will be cancelled for that week. After 2 occurrences your service will be cancelled permanently. Mow-NoMore is not responsible for damage done by flying debris from equipment, lawns should be free of/from objects (other than grass of course) before our staff arrives. Mow-NoMore is not responsilble for damage done to sprinkler systems. Heads should not protrude, and the system should be shut OFF on the day of service. If the sprinkler system activates during service, we will stop service immediately and consider it complete for that week regardless of percentage completed. If your service date should get rained out, we will attempt to complete service over the next three (3) days, after which we will cancel until the next week and you will not be charged.  Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by binding arbitration administered by the arbitration platform of our choosing, in accordance with its Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Each party further acknowledges and agrees that communications from the arbitration platform, including initial notification of a dispute, shall be sent to the email addresses set forth for such party on the signature page hereto or to such email addresses customarily used by each party for the other party hereto, unless otherwise notified to the other party in writing in accordance with the notification provisions in this contract. The parties hereto understand the importance of ensuring that they are notified of a dispute and therefore represent that they have been careful to identify an email address to which they believe they will always have unfettered access. Nothing in this clause shall prevent a party from seeking provisional remedies in aid of arbitration from a court of competent jurisdiction. Mow-NoMore reserves the right to cancel or refuse service at any time for any reason.
